No crime if the pirate software is used by professional firms

In a recent ruling (No. 49385 of December 22, 2009), the Italian Corte di Cassazione decided on the use of programs obtained through license (pirated) within a professional firm. The Supreme Court declared that a professional firm using pirated software is not punishable, emphasizing the fact that the law indicates only entrepreneurs or traders. Illegal reproduction of softwares - when proved - is however always punishable.
