Tripp Trapp

By decision of 18 September 2014 the High Court of Justice has ruled on a topic related to the possibility to register as a trademark characterizing shapes such as the shape of the children’s chair “Tripp Trapp” sold by the Dutch company Stokke Nederland BV.


The Court has stated that shapes of goods with essential characteristics which are inherent to the generic function of such goods must be denied registration, since reserving such characteristics to a single economic operator would make it difficult for competing undertakings to give their goods a shape which would be suited to the use for which those goods are intended.
