With the recent decision of June 27th 2013, the General Court (EGC) ruled on the interpretation of art. 25, par. 1, lett E) of Regulation CE n. 6/2002. The General Court affirmed that the rule must be applied to all cases in which the sign reproduced in the design or model - whose invalidation is requested - is similar to the prior sign, not identic. The test to establish the similarity must be based on the overall impression of the two signs.
