TRADEMARKS - Gianni Versace won its decade old legal battle against the Israeli company Versace 83 Ltd

The Tel Aviv District Court has recently rejected the arguments of acquiescence, waiver of rights and laches used by the defence of Versace 83 Ltd., the Israeli company that has been using the trademark VERSACE since 1983, against whom the famous Italian fashion company has been conducting legal proceedings since 2000. The Court ruled that the Israeli company's behaviour over the years clearly constituted trademark infringement, passing off, unjust enrichment and unbearable deception of consumers. The Court ordered the company to permanently cease the use of the trademark VERSACE (both in Latin and Hebrew letters), as well as to refrain from using the Medusa Head Design and the design known as the "Greek Key Frame".
