Revision of UK trade mark time limits' calculation

The UK IPO is shortly about to issue a Tribunal Practice Notice revising the calculation of certain time limits for UK trade mark matters. The most important of these is the calculation of the opposition time period: as of 31 March 2013, the time period for filing opposition is 2 months beginning the day immediately after the publication date of the trade mark application, rather than the current system of beginning on the day of publication. The new system will bring the UK into line with the system for calculating the opposition period for Community trade marks. Transitional provisions will mean that any time period not yet expired on 31 March 2013 will be calculated under the new system.
