Great protest in Munich before the EPO by environmental associations, committees and farmers, for the cancellation of the oral proceedings scheduled for 26.10.11 at which the EPO should have decided whether to find admissible the opposition filed against the granting of patent EP 1069819, protecting a particular vegetal variety of broccoli obtained by traditional crossbreeding methods. The EPO has cancelled the oral proceedings as it has considered to maintain the patent in the new version submitted by the patent owner (which limits the scope of protection to the final product, excluding the process claims). The patent will therefore be confirmed. In the meantime, the patent owner, Plant Bioscience Ltd of Norfolk, has already undertaken the sale of the concerned broccoli in Great Britain, in Marks & Spencer supermarkets.
