Mediaset does not renew his domain name.com that is bought at an auction by an American citizen

The Cologno Monzese-based company did not renew in time the domain name www.mediaset.com, and after the grace period has expired, a company that sells domain names at auctions bought it and then resold it to Mr. Didier of Madiba Fenicius Llc, a Delaware resident. Mediaset has thus started the legal practices to regain possession of the domain name, starting the procedure for reassignation and based its claim on three factors: the identity / similarity of the domain to the trademarks owned by Mediaset SpA, the lack of interest of Mr. Madiba for the purchased domain name and the purchase and use in bad faith. By an order dated February 4, 2012 the Arbitration and Mediation Center of the World Intellectual Property Organization (WIPO) has rejected the claims of Mediaset SpA and determined that it failed to prove the bad faith of Mr. Madiba, as it provided general allegations not supported by specific circumstances or specific examples.
