Invalidity of International Design Registrations

International registrations of designs designating the European Union may be subject to invalidity proceedings before OHIM, according to Article 15 Geneva Act and Article 106f Community Design Regulation. The grounds for invalidation are provided by Article 25(1) of the Community Design Regulation, which also apply to registered Community designs. In case the invalidity application is well grounded, a decision of OHIM will affect ONLY the European Union, not the International registration. WIPO will be notified accordingly when an International registration in the European Union is declared invalid by a final decision.
