International Anti-counterfeiting Treaty and European reactions

After the consecration of the Sarkozy doctrine concerning Internet disconnections in France and in the light of the rumours about the ACTA (Anti-Counterfeiting Trade Agreement) involving the diplomacy of major European and World countries and also some of the most influential leaders of the digital content market, it came with no surprise the recent amendments to the Telecom package that the European Parliament is now discussed. It is recent the news of an agreement reached between the European Parliament and European Council on the “Amendment No. 138” regarding the Telecoms Package and the enforcement of copyrights in the digital content market. After several drafts and changes of direction, in particular on the ease of access by the copyrights holders to the Internet disconnection protection, the compromise was formed on: - Liability of Internet Service Providers to be settled at national level; - Presumption of innocence and protection of user's right to privacy; - Greater weight given to the principle of due process.
