Hermès vs Rothschild - the first meta lawsuit?

The french luxury company Hermès has sued on friday Mason Rothschild for its MetaBirkins, 100 NFT representation of the famous bags, which Rothschild has sold for apparently around 42.000e each. Hermès accuses the NFT creator of being “a digital speculator who is seeking to get rich quick by appropriating the brand Metabirkins for use in creating, marketing, selling, and facilitating the exchange of digital assets known as non-fungible tokens (NFTs).” It continues that the “Metabirkins brand simply rips off Hermès’ famous Birkin trademark by adding the generic prefix ‘meta’ to the famous trademark Birkin”, while the artist answers that he is only creating art and not infringing any IP right.
While we wait for the decision of the Court, theimportance of protecting also on the metaverse becomes everyday more clear.
