Facebook has been convicted of copyright infringement of Mediaset: a precedent of relevance for the future of Italian jurisprudence?
Having hosted a page containing links to episodes of a cartoon broadcasted by the Mediaset network (uploaded on Youtube by unauthorized third parties) has costed to Facebook a conviction for infringement of copyright.
This is an absolute novelty in the Italian jurisprudential panorama. Never before sentence no. 3512/2019 of the court of Rome, a social network was held responsible for the violation of copyright through "linking" activities carried out by its users. It will be interesting to check whether the other EU Courts will also adapt to this case which, seems to comply and even anticipating them, with the contents of the new controversial EU Directive on copyright.
