First case of criminal condemnation of Google for publishing contents on the web

The Court of Milan has recently condemned three executives of Google Italy for the publication of a video, which showed a child suffering from Down syndrome molested by four students of a technical institute in Turin. The movie had been online for about two months in 2006 and was removed only after the police’s alert. In particular, the three executives were condemned for impingement of privacy, while they were acquitted of defamation. The decision of the District Court of Milan concerns the protection of the person through the protection of privacy and is the first world-wide case of criminal condemnation of Google’s executives for online publications. The American Department of State and the same Google were very disappointed. In particular Google has affirmed that the decision in suit represents an attack to the fundamental principles of freedom upon which Internet has been established. Google has also affirmed that it will lodge an appeal against this decision.
