Filters and illegal content

With sentence of November 27th, 2011 the EU Court of Justice has stated that, in relation to a controversy between the Belgium provider Scarlet Extended SA and Sabam, national judges can not impose to an internet provider to use filters for preventing the downloding of illegal contents. According to the UE Court of Justice, the imposition of such a system of "filtering" is incompatible with the directive on the electronic commerce and with the fundamental rights of the European Union.
