The UK Intellectual Property Office has recently issued a Tribunal Practice Notice clarifying the deadline for UK trade mark opposition filing. In accordance with the new Practice Notice, the deadline for filing a UK trade mark opposition is now 2 months (extendable to 3 months) beginning with (instead of after) the date of publication. For example, a trade mark published on 24 September 2010 has an opposition filing deadline of 23 November 2010. However, the remaining deadlines such as that for filing the counterstatement or filing the request for entering or extending the cooling off period are time periods that extend after the relevant date, so are calculated as usual.
