Conviction for Google for the association between a person's name and the words "scam" and "swindler"

By order of March 24th, 2011, the Court of Milan held that the search engine Google was non-contractually liable (pursuant to Art. 2043 of the Civil Code) for the association between a person's name and the words "scam" and "swindler "made ​​by the software " suggest search ", arranged by the Google. The action was brought by a businessman who claimed that by typing its name into Google, the software "suggest search" suggested completing the search with the words "scam" and "swindler". The petitioner complained that this constituted an act of defamation resulting in attacks upon his honor, his personal and professional reputation and image. By the order mentioned above, the Court of Milan dismissed the appeal instigated by Google, thus confirming the order of January 25th, 2011 issued by the Court of first instance for preliminary measures. The latter had in fact ordered the search engine Google to remove from its software the association between the petitioner's name and the words "scam" and "swindler" and condemning the same to the payment of a sum of money for each day of delay in complying with the order.
