COPYRIGHT: Usenet.com held liable for copyright infringement

The Recording Industry Association of America (RIAA) scores another goal against peer to peer filesharing. Usenet.com has been held liable of copyright violation for having conducted an active role (direct and contributory liability) in sharing copyrighted works between users. Justice Harold Baer, of New York South District Court, has in fact rejected Usenet.com defence based on the principles of the historical precedent Sony Betamax. In the said case, the Court considered that non-infringing uses of the VCR were quantitatively more relevant than the illegal ones, but the quantification of non-infringing uses criterion has not been enough to clear Usenet.com of charges. The constant and relationship with its users and the advertising campaigns aimed at promoting filesharing on its networks have led the Court to extend the liability from users to the provider.
