Battle in Switzerland between telephone companies

Swisscom and Sunrise, two major telephone companies, holders of the "inOne" and "one" trademarks respectively, have taken legal action to obtain the revocation of the competitor's trademark protection as they are confusing.
In a recently published judgment, the Commercial Court of Zurich, on the other hand, held that neither trademark could be protected under the relevant law. They are - explains the court - terms of general use, such as "you" or "duo", and therefore are freely usable by all companies.
However, the court made an exception for the colored logos of "inOne" (pink-red-purple-blue) and "one" (yellow-orange-red) of the two companies: which remain protected and cannot be used by others .
An appeal can still be filed by January 27th.
