Apfelkind against Apple: the small business wins

Christina Römer can continue to use its own brand: a red apple with the profile of a child together with the word "Apfelkind", where "Apfel" stands for apple and "Kind" for child. This trademark was registered in 2011 in Germany by Christina Römer and used for the her family-run coffee shop. Apple, considering the sign in question in infringement of its own international trademark, had sent a warning letter to the German café requesting Christina Römer to withdraw the trademark "Apfelkind" or at least to refrain from using it. Apple had also filed an opposition to the trademark in issue before the German Office for trademarks and patents. After several negotiations, Apple has decided to withdraw its opposition.
