Accession to the Madrid Protocol: KAZAKHSTAN

On September 8, 2010, Kazakhstan has become part of the Madrid Protocol concerning International trademarks, after the decision of its Government together with the director of WIPO. The Madrid Protocol will effectively enter into force in Kazakhstan on December 8, 2010. Such ammission brings the number of countries part of the Protocol to 83, whereas 85 are the countries members of the Agreement. It is important to highlight that becoming part of the Protocol - differently from the Agreement (for which the international trademark registration is bound for the first 5 years to the domestic trademark) - will give the possibility, in the event of a central attack, to file within three years from the date of the registration's radiation an application for the same trademark (conversion) in all the designated countries, except for the country of origin.
