The European Commission referred to the European Court of Justice asking for an opinion on the compliance of the agreement with the fundamental rights of the European Community. The Commissioner for Trade, Karel De Gucht, said that the opinion of the Court of Justice is an essential step in order to clarify all the doubts that the agreement has generated. Consequently, the ratifications in progress by the national governments are suspended till the opinion of the European Court of Justice.
